8.0 Mandated Body
The Tapuika Iwi Authority (TIA) Board of Trustees is the body seeking to re confirm the mandate from its Iwi members to enter into negotiations with the Crown for a comprehensive settlement of Tapuika’s historical claims within the area described as Te Takapu o Tapuika, and to receive the on-account offer from the Crown dated 19 June 2008.

8.1 Background to the Tapuika Iwi Authority Trust
The Tapuika Iwi Authority was established at a Special Hui a Iwi held on 14 December 1994 at Tia Marae, Te Paamu. Those present at the Hui unanimously resolved to establish a tribal authority to be known as the Tapuika Iwi Authority. The Tapuika Iwi Authority was registered in 1995 as an Incorporated Society in accordance with the Incorporated Societies Act, 1908.

Since that time Tapuika Iwi Authority has continued to operate for the benefit of its tribal members who are descendants of Tapuika and has maintained its mandate through regular hui with the tribe, including nationally.

8.2 Legal Status
A Special General Hui of Tapuika duly notified on the 10th December 2006, ratified the establishment of Tapuika Iwi Authority as a Common Law Trust and resolved to adopt the new Trust Deed.

8.3 Governance
Governance of the newly constituted Trust comprises of 11 trustees made up of 2 hapu representatives per hapu and 3 Tapuika ki waho representatives.

The Trustee representatives as at 30 June 2008 are:

  • Te Hira Roberts(initial trustee) Ngati Kuri
  • George Skudder (Chair) Ngati Marukukere
  • Carol Biel Ngati Moko
  • Ian McNeill Ngati Moko
  • Teia Williams Ngati Tuheke
  • Te Papara Marsh Ngati Tuheke
  • Ateremu McNeill Tapuika ki Waho- South Island
  • Dr Hinematau McNeill Tapuika ki Waho – Northern N.Island

Vacancies on the TIA Board of Trustees as at 30 June 2008;

  • Ngati Marukukere representative (additional one Trustee)
  • Tapuika ki Waho Central N.Island representative

8.4 Elections of Trustees
The Trustees are elected in accordance with the rules and procedures set out in the Second Schedule of the Tapuika Iwi Authority Deed of Trust (see Attachment Two)

8.5 Eligibility for Appointment as Trustee
To be elected as a Trustee a person must, at the closing date for nominations, be recorded on the Tapuika Register as a Tapuika descendant aged 18 years and over as at their last birthday.

9.0 Organizational Structure
The Tapuika Iwi Authority organizational structure is as shown in Table 1 below;

Organisation Structure

Taumata or Advisory Trustees comprise Tapuika koroua and kuia whose primary role is:

  • to protect the mauri of Tapuika
  • provide advice to the Authority on matters relating to tikanga, kawa, waiata, reo and whakapapa

The Tapuika Iwi Authority responsibilities include:

  • to ensure compliance with the statutory duties and obligations as set out in the Trustees Act 1956
  • receive settlement assets on behalf of the claimant group
  • prudent governance of the Authority on behalf of the members of the tribe and in accordance with the Trust Deed
  • to ensure the benefits of any assets or settlement grows for the future generations of Tapuika
  • overall governance of the Group
  • appointment and removal of Directors and Trustees onto the Governance of the subsidiary entities
  • ownership and sole shareholder of the subsidiaries on behalf of its constituent iwi members as listed on the Iwi Register
  • appoints and removes the trustees of the charitable trust.

Tapuika Holdings Ltd role is to receive and utilize assets transferred or allocated to it by the Authority for the purpose of:

  • growing and developing the tribal economic base
  • generating sufficient cashflow on an annual ongoing basis to fund iwi development and administration activities
  • maximize profit

Tapuika Iwi Authority Charitable Trust role is to;

  • monitor the Crown and its agencies on the delivery of equitable universal outcomes in relation to health, education, housing and employment
  • monitor the Crown and local government environmental outcomes aligns to Tapuika’s environmental policies
  • monitor and maintain Tapuika’s interest under the Resource Management Act
  • including response to resource consents, submissions

  • protect and enhance sites of cultural significance
  • undertake iwi development activities i.e. Tapuika tikanga, mana matauranga, iwi community facilities, funding hapu cultural, social, economic development
  • maintain and enhance relationships with related socio-economic entities
  • report annually to the TIA Trust Board

9.1 Transparency & Accountability
The governance entity will meet the requirements for transparency, accountability and inclusiveness by;

  • give notice calling for nominations for Trustees at least 3 months prior to the Annual General Meeting each year
  • holding of Annual General Meetings no later than October 30th each year
  • publicly advertising Annual General Meetings in local and other medium at least 21 days in advance of the meeting
  • presentation of annual audited financial statements to the Annual General Meeting each year
  • minutes of Tapuika Iwi Authority meetings are available to members of Tapuika who are registered on the Iwi Register
